These Terms constitute a legally binding agreement between you and Zarmiquo. If you are accessing the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Zarmiquo provides an online platform offering structured cognitive assessment tools and educational content related to cognitive psychology and psychometrics. Our services include interactive IQ and cognitive reasoning assessments, educational articles, score explanations and contextual reporting, and information about cognitive science.
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with or without notice.
The assessments and content provided through Zarmiquo are designed exclusively for educational and personal insight purposes. They do not constitute psychological testing, clinical evaluation, medical diagnosis, or professional advice of any kind.
Results from Zarmiquo assessments should not be used as the basis for clinical decisions, educational placement decisions, employment decisions, or any other high-stakes determination about an individual. Zarmiquo expressly disclaims any responsibility for outcomes arising from the misuse of assessment results in such contexts.
If you have concerns about your cognitive health or functioning, please consult a qualified licensed mental health professional or physician.
Zarmiquo does not guarantee any specific results from use of its assessments, and results will vary by individual, testing conditions, and other factors beyond our control.
By using the Platform, you agree not to:
Certain features of the Platform may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
All content on the Platform — including but not limited to text, assessment questions, graphics, logos, icons, images, and software — is the property of Zarmiquo or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.
You may view, download, and print Platform content for your personal, non-commercial use only, provided you do not modify the content and retain all copyright and proprietary notices. Any other use, including reproduction, distribution, display, or transmission of Platform content, requires express prior written consent from Zarmiquo.
THE PLATFORM AND ALL CONTENT, ASSESSMENTS, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ZARMIQUO DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY ASSESSMENT RESULTS OR EDUCATIONAL CONTENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZARMIQUO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID TO ZARMIQUO IN THE SIX MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of liability for certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
You agree to indemnify, defend, and hold harmless Zarmiquo, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your violation of these Terms, your use of the Platform, or your violation of any third-party right.
These Terms shall be governed by and construed in accordance with the laws of the State of Montana, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or use of the Platform shall first be addressed through good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the American Arbitration Association rules, with proceedings conducted in Blaine County, Montana.
We reserve the right to modify these Terms at any time. Changes will be indicated by updating the "Last Updated" date above. Your continued use of the Platform after any changes constitutes acceptance of the revised Terms.
